Chi vuol far valere nella Repubblica un lodo straniero deve proporre ricorso al presidente della corte d'appello nella cui circoscrizione risiede l'altra parte; se tale parte non risiede in Italia è competente la corte d'appello di Roma.Il ricorrente deve produrre il lodo in originale o in copia conforme, insieme con l'atto di compromesso, o documento equipollente, in originale o in copia conforme.Qualora i documenti di cui al secondo comma non siano redatti in lingua italiana la parte istante deve altresì produrne una traduzione certificata conforme.Il presidente della corte d'appello, accertata la regolarità formale del lodo, dichiara con decreto l'efficacia del lodo straniero nella Repubblica, salvoché:1) la controversia non potesse formare oggetto di compromesso secondo la legge italiana;2) il lodo contenga disposizioni contrarie all'ordine pubblico (2). | Whoever wishes to enforce a foreign arbitral award in Italy must file an appeal with the president of the court of appeal in whose district the other party resides; if this party does not reside in Italy, the Court of Appeal of Rome is competent.The applicant must produce the original or a certified copy of the arbitral award, together with the compromised deed, or an equivalent document, in original or in a certified copy.If the documents referred to in the second paragraph are not written in Italian, the applicant must also produce a certified translation of them.The president of the court of appeal, having ascertained the official regularity of the arbitral award, declares with a decree the effectiveness of the foreign arbitral award in Italy, unless:1) the dispute cannot not be subject to compromise according to Italian law;2) the arbitral award contains provisions contrary to the public policy. |
Contro il decreto che accorda o nega l'efficacia del lodo straniero è ammessa opposizione da proporsi con citazione dinanzi alla corte d'appello entro trenta giorni dalla comunicazione, nel caso di decreto che nega l'efficacia, ovvero dalla notificazione nel caso di decreto che l'accorda.In seguito all'opposizione il giudizio si svolge a norma degli articoli 645 e seguenti in quanto applicabili. La corte d'appello pronuncia con sentenza impugnabile per cassazione.Il riconoscimento o l'esecuzione del lodo straniero sono rifiutati dalla corte d'appello se nel giudizio di opposizione la parte contro la quale il lodo è invocato prova l'esistenza di una delle seguenti circostanze:1) le parti della convenzione arbitrale erano incapaci in base alla legge ad esse applicabile oppure la convenzione arbitrale non era valida secondo la legge alla quale le parti l'hanno sottoposta o, in mancanza di indicazione a tale proposito, secondo la legge dello Stato in cui il lodo è stato pronunciato;2) la parte nei cui confronti il lodo è invocato non è stata informata della designazione dell'arbitro o del procedimento arbitrale o comunque è stata nell'impossibilità di far valere la propria difesa nel procedimento stesso;3) il lodo ha pronunciato su una controversia non contemplata nel compromesso o nella clausola compromissoria, oppure fuori dei limiti del compromesso o della clausola compromissoria; tuttavia, se le statuizioni del lodo che concernono questioni sottoposte ad arbitrato possono essere separate da quelle che riguardano, questioni non sottoposte ad arbitrato, le prime possono essere riconosciute e dichiarate esecutive;4) la costituzione del collegio arbitrale o il procedimento arbitrale non sono stati conformi all'accordo delle parti, o in mancanza di tale accordo, alla legge del luogo di svolgimento dell'arbitrato;5) il lodo non è ancora divenuto vincolante per le parti o è stato annullato o sospeso da un'autorità competente dello Stato nel quale, o secondo la legge del quale, è stato reso.Allorché l'annullamento o la sospensione dell'efficacia del lodo straniero siano stati richiesti all'autorità competente indicata nel numero 5) del terzo comma, la corte d'appello può sospendere il procedimento per il riconoscimento o l'esecuzione del lodo; su istanza della parte che ha richiesto l'esecuzione può, in caso di sospensione, ordinare che l'altra parte presti idonea garanzia.Il riconoscimento o l'esecuzione del lodo straniero sono altresì rifiutati allorché la corte d'appello accerta che:1) la controversia non potesse formare oggetto di compromesso secondo la legge italiana;2) il lodo contenga disposizioni contrarie all'ordine pubblico.Sono in ogni caso salve le norme stabilite in convenzioni internazionali (1). | Against the decree that grants or denies the effectiveness of the foreign arbitral award, objection can be proposed with summons before the Court of Appeal within thirty days from the communication, in case of a decree that denies the effectiveness, or from the notification in case of a decree that grants it.Following the opposition, the judgment is carried out in accordance with articles 645 and subsequent as applicable. The court of appeal pronounces with a sentence appealable before the Court of Cassation.The recognition or execution of the foreign award is refused by the Court of Appeal if in the opposition proceeding the party against whom the arbitral award is invoked proves the existence of one of the following circumstances:1) the parties of the arbitration agreement were incapable according to the law applicable to them or the arbitration agreement was not valid according to the law to which the parties submitted it or, in the absence of indication in this regard, according to the law of the state where the arbitral award was pronounced;2) the party against whom the award is invoked was not informed of the appointment of the arbitrator or the arbitration proceeding or in any case was unable to assert his defence in the proceeding itself;3) the arbitral award was pronounced on a dispute not contemplated in the compromise or in the arbitration clause, or outside the limits of the compromise or the arbitration clause. However, if the rulings of the award concerning questions subject to arbitration can be separated from those that concern matters not subject to arbitration, the former may be recognised and declared enforceable;4) the establishment of the arbitration panel or the arbitration proceeding were not in accordance with the agreement of the parties, or in the absence of such an agreement, with the law of the place of the arbitration;5) the award has not yet become binding on the parties or has been cancelled or suspended by a competent authority of the state in which, or according to the law of which, it was rendered.When a request has been made to the competent authority indicated in number 5) of the third paragraph for the cancellation or suspension of the effectiveness of the foreign award , the court of appeal may suspend the procedure for the recognition or execution of the arbitral award; at the request of the party that requested the execution, it may, in the event of suspension, order that the other party provides a suitable guarantee.The recognition or execution of the foreign award is also refused when the court of appeal finds that:1) the dispute cannot be subject to compromise according to Italian law;2) the arbitral award contains provisions contrary to public policy.They are in any case subject to the rules established in international conventions. |
