CMS advises EBRD on financing Kyiv Medical University

12 March 2024

International law firm CMS has advised its longstanding client, the European Bank for Reconstruction and Development (EBRD), on a EUR 2.5m loan to Kyiv Medical University (KMU) for the completion of a new campus for its students, which has been partially relocated to Poland in the wake of the 2022 Russian invasion.

KMU is a private educational institution that provides graduate and postgraduate medicine, dentistry and pharmacy education to 3,400 students in Ukraine and Poland. Recently, KMU bought two properties in Katowice and Chorzów, and is renovating the buildings and buying new equipment that will benefit their multicultural students.

The project will bring new courses and 35% more students, with the Polish campus expected to generate 38% of the company’s revenue this academic year and to facilitate the creation of more than 200 work placements for doctors and educators.

CMS Banking & Finance partner Rafał Zakrzewski comments: “We are delighted to once again be able to support the EBRD with projects that are important for local communities. This time, thanks to the funding and implementation of the new campus, more than 2,000 students from KMU will benefit, gaining not only new infrastructure but also access to new education programmes.”

CMS Poland’s Banking and Finance team’s advice included representing the client, preparing and negotiating the loan agreement under English law and collateral documentation under Polish law, and coordinating the entire project. CMS Poland’s Real Estate team coordinated the due diligence process of the project sites.

The CMS Banking and Finance team was led by partner Rafał Zakrzewski with support from associate Krzysztof Schulz.

CMS Poland’s Real Estate team was led by partner Dominik Rafałko and supported by senior associate Zuzanna Bafia and lawyer Marta Trębacka.
